MAYNARDVILLE (WATE) – An alleged intruder was killed by a homeowner early Thursday morning in Union County.
Sheriff Billy Breeding says his office received a 911 call around 4 a.m. from a home on Beard Valley Road that two masked persons armed with guns had forced their way into the home. The caller said one of the intruders had been shot and the other ran off.
The intruder, James Dilbert Teague, was fatally shot during the incident.
“They had masks on like Halloween. We still don’t know who they were,” said the family’s next door neighbor and relative, Misty Houghtelli, about the intruders. She said a grandmother and her four grown grandkids were targeted.
Houghtelli said it was one of the grandsons that fired the shot that killed Teague. Deputies arrived on scene and found him dead of a gunshot wound.
A Maynardville man, Justin Lee Kiser, was identified as the masked-armed robber that fled the scene on foot.
Kiser was charged with especiallyaggravated kidnapping and is being held at the Union County jail under a $250,000 bond.
The investigation is ongoing. The sheriff’s office has not released the names of anyone involved.
WATE 6 On Your Side legal analyst Greg Isaacs said if someone’s in your home, you are legally justified to use deadly force. However, he said if someone is in your driveway, peering through your window, or at your back door and you shoot and kill them, you can be charged with homicide.
