KNOXVILLE (WATE) – The case against former Knox County trustee Mike Lowe, Ray Mubarak and Delbert Morgan will move forward.
The three were all charged with theft more than two years ago, accused of funneling money through the trustee’s office.
In a motions hearing Monday, a judge dismissed the defense’s request to have the cases dismissed.
Defense attorney Greg Isaacs had asked for the dismissal in court Thursday saying it took two years for the grand jury to bring an indictment and during the delay, evidence was destroyed.
Investigators believe fake payments were being made to ghost employees to a company Mubarak owned and the money was then being pocketed.
Jury selection in the trial for Morgan, an alleged ghost employee, is scheduled to start Tuesday morning.
